Got hit by a driver with AAA in Texas.? I was driving in my car and taking a left hand turn off a one way street. I used my blinker, slowed before my turn and then i heard screeching from behind me as i entered my turn. As my car was in the turn i was hit in the back drivers side. I called the police and we were informed that it would be at least 2 hours before someone could come out and they asked if we could settle it on our own. So we did... the driver gave me his insurance and said sorry. He never asked for my insurance and he admitted fault. We took numerous pictures of the damage, of my car and the drivers car and of the intersection where it happened.
AAA has finally contacted me and is giving me the run around and telling me that if they don't accept liability that i am liable for the storage cost and rental car fee's for the accident. I was not at fault, hell i was hit from behind. So is this just a tactic to try to get me to take my car out of storage? What are my rights in the state of Texas?
I wouldn't say that they are trying to get you to take your car out of storage. They are telling you that at this time they are still investigating the accident and liability has not been determined. They are warning you now that if they don't accept liability, you will be responsible for the storage fees and rental fees that are accumulating. They are telling you now so that you can't come back and say that you were unaware. Based on the fact that there is no police report, there is a very good chance they will deny the claim saying it is your word versus their insured. I would go to the police station, explain the situation to the desk sergeant that the police couldn;t come to the accident scene the other day, and file a police report. I know you say he accepted liability and apologized but people change their story all the time. Human nature is to avoid blame.
If AAA doesn't accept liability, you have a couple options in this case.
1.) If you have collision coverage, you can go to your insurance company. They will pay for your repairs, the storage, and the rental and they will try to recoup the money they spend from AAA. This will get your car fixed but your rates will most likely go up. If you don't have collision coverage or don't want to file a claim under your insurance you can.
2.) You can get an attorney like the other people said but there are a lot of problems with getting an attorney involved in an insurance claim.
A.) it would be hard to find a lawyer to take an auto claim because the money is too small. Lawyers generally only take injury cases because they can make a lot more money.
B.) a lawyer would never actually take this kind of case to court because it would cost more to go to court than the entire claim is worth. Instead the attorney would try to negotiate the claim and take a reduced settlement so they don't have to go to court. This is going to mean less money for you
C.) the attorney is going to take a third of the reduced settlement they collected further reducing the money you would get.
D.) when an attorney gets involved in an insurance claim, it sets off warning signals to insurance adjusters and the claim is handled differently. namely the insurance company is going to hire an attorney to deal with your attorney and the entire process is going to be drug out over years
Getting an attorney is going to result in you waiting a really long time to get a really disappointing settlement.
3.) An alternative to getting an attorney is hire a Subrogation Company that is a member of "intercompany arbitration". A subrogation company is a company that specializes in recovering money from insurance companies. "Intercompany arbtiration" is an alternative to court where the 2 companies present their case to a panel of insurance professionals. The panel then decides who is at fault and forces the at fault party to pay the other parties damages. The decision is legally binding like a court decision but it is way cheaper and way faster. I did this myself with a subrogation company called Cerberus Subrogation Professionals. www.cerberussubro.com if you want to get in touch with them. They were the only subrogation company I could find that was actually a member of the arbitration group. That is important. If the subrogation company is not a member of arbitration, they can't file arbitration and they will just negotiate your claim the way an attorney does. Arbitration worked great for me. We won the whole amount we went after. It was a lot cheaper and a lot faster than getting an attorney. Plus, I didn't have to submit a claim to my insurance.

Call one of the towing companies that are AAA approved. This is expensive to do and if there were any better time to learn to change a tire, now is a good time to try.
