We have been continuously harrassed by the Dept of Education for a loan that has ABSOLUTELY nothing to do with us for the past 10 years. They have even sent a letter confirming as much and have (supposedly) marked our contact details as do not call. Yet, we continue to get annoying and at times obnoxious and intimidating calls from bill collectors. The most recent this morning. We are on the do-not-call list. Is there any way to subject these callers to the do-not-call violation penalties given that they know (or should have known) that we have nothing to do with the bill. Or are there any other means to stop this continuing harrassment.

the do not call list is for solicitors, such as someone selling something. If someone is collecting a debt, that is different. If you have clearly proven to them that the debt is not yours, you can possibly sue them for harassment. Start off by sending a certified letter to them telling them to cease and desist contacting you. If they continue, then sue them.



Is surveyors calling numbers on the "Do Not Call List" a violation of federal law?
Yesterday, I received a call around mid-afternoon from a surveyor who wanted to ask about my political views, about 15 minutes later though after I hung up, it hit me that I had registered my cell number last July on the "National Do-Not Call Registry", and I was wondering if that would be just as much a violation as a telemarketer calling? I'm not planning to take any action now, since I should of complained about them calling my cell phone right then and there, but for the next time could I file a complaint? I've received opposite answers so far on the subject from my friends, some have said yes, while others have said that the surveyors are exempt from the Do Not Call List.

Your mother might care. I firmly believe that the "no call list" is a scam to get all our unlisted phone numbers in one place so it can be sold to telemarketers. I never got those calls until I put my number on a no call list. Now I get one every day. or more than one. Back when the list was supposed to go into effect the advertisers got an injunction to keep it from being in effect. In the meantime they distributed the list of "no Call" numbers freely and with wanton disregard for your desires. Now that the numbers are "out there" the only way to stop the call is to tell each and every caller that they will be charged with a violation when they call, Only after you have told them not to call and they call again is there a violation. The problem is proof they called again and again. You can keep a list of the numbers who call you from your caller ID, but if they call from a blocked number you won't have it. You have to write all the information down every time they call. I usually don't have the patience. And if it is an automatic dial, and a recorded number, forget ever being able to tell them not to call.
