How to get W-2 from an out of business employer?
I'm worried about getting my W-2 for 2006 because my employer went out of business. He had hired a CPA to keep tack of the payroll and tax information. They generally sent my boss the W-2s to mail out to the individual employees. My question is this, does the CPA still legally have to prepare the W-2 forms eventhough they are no longer being paid by my old employer. And if they do, is there a way I can get them to send my W-2 to me directly since I do not trust my old employer to get his act together and actually mail me my W-2. I'm really worried about this and I need to know what my options are.
All W-2 forms must be issued by 1/31 of the current year for the previous year. You should contact the CPA directly and ask if they are preparing the W-2 forms and if they are give them your current address. If they are not see if they know who is. If they do not know contact your local IRS office and advise them of the situation. You can find information regarding this type of situation on www.irs.gov.

If you do not receive the missing or corrected form W2 by February 15th from your employer/payer, you may call the IRS at 1-800-829-1040 for assistance. You must provide your name, address (including zip code), phone number, Social Security Number, dates of employment, your employer/payer's name, address (including zip code), and phone number. The IRS will contact the employer/payer for you and request the missing form. IRS will also send you a Form 4852 (PDF), Substitute for Form W-2 or Form 1099-R.
If you do not receive the missing form in sufficient time to file your tax return timely, you may use the Form 4852. If you receive the missing or corrected Form W-2 or Form 1099 after you file your return and a correction is needed, use Form 1040X (PDF), Amended U.S. Individual Income Tax Return. Refer to Topic 308, Amended Returns, for additional information.
